Supreme Court refuses to stay HC verdict on Lieutenant-Governor powers

The Delhi government has filed six appeals challenging the HC judgement that held the Lieutenant Governor (LG) as the administrative head of the national capital.

The apex court bench headed by Justice AK Sikri also declined to stop the functioning of a three-member panel set up by LG Najeeb Jung to scrutinise 400-odd files related to decisions taken by the AAP government without his concurrence.

The High Court had earlier held that Delhi would continue to remain a Union territory under the Constitution with the LG as its administrative head.

"Terming it as a setback would be wrong as the Supreme Court has listed the matter for further hearing, and also said that it may consider sending the petitions to a larger Bench".

Firstly, the appeal by the Delhi Government was filed and sworn by Deputy Chief Minister, who is not authorised under Rules of Business to do so.

Venugopal, however, pleaded that Sisodia had to move the apex court as no Secretary was not ready to sign it in the absence of LG's nod.

During the hearing, Rohatgi, who said the issue as to whether Delhi is a state or a UT has been settled by a 9-judge bench verdict, submitted that if the cases are to be referred to a larger bench, then they will have to be heard by a 11-judge Bench of the Supreme Court.

The Delhi Government rebutted the Centre's objections by referring to a series of recent orders issued by the L-G starting from launching an investigation into all decisions taken by the Delhi Government.

Venugopal said the issue being raised affects not only the popularly elected present Delhi government but future governments as well.

The Delhi government on May 28 previous year had moved the high court, a day after the Centre had approached the Supreme Court challenging a high court order which had termed as "suspect" the Union Home Ministry's notification barring the city government's ACB from acting against its officers in criminal offences.

"There can not be a committee finding fault with the previous decisions of the elected government. on the basis of the judgment of the high court, legitimacy can not be given to a committee to look into them".
