Trump sued over transgender military ban

The federal lawsuit was filed in Maryland on Monday by the ACLU of Maryland on behalf of an 11-year Navy veteran who served in Afghanistan, and several other transgender members of the armed forces.

The two lawsuits follow an August 9 lawsuit featuring "5 transgender service members with almost 60 years of combined military service", according to a statement from the National Center for Lesbian Rights and GLBTQ Legal Advocates & Defenders.

"After consultation with my Generals and military experts, please be advised that the United States Government will not accept or allow Transgender individuals to serve in any capacity in the U.S. Military", Trump wrote in the tweets.

Obama lifted the previous ban on transgender service after an inquiry led by his defense secretary, Ashton Carter, concluded the ban's reversal was unlikely to have a negative impact on military readiness. Stone has received numerous commendations for his service.

Trump's move halted years of efforts to eliminate barriers to military service based on sexual orientation or gender identity, including a 2016 order by Obama created to let transgender people serve without fear of discharge.

Both lawsuits say the ban is a violation of equal protection and due process; the Lambda lawsuit also says it violates free speech protections.

Trump's directive calls for a new policy to ban trans people from enlisting and cut off healthcare coverage for transition-related surgery, a bugbear for many congressional conservatives, within six months.

The ban is "purely political", the ACLU said, "reflecting a desire to placate legislators and advisers who bear animus and moral disapproval toward men and women who are transgender". "Indeed, the Memorandum on its face demonstrates that it is directed at suppressing the gender expression and related expressive conduct of transgender individuals, including that of the individual plaintiffs and transgender members of the organizational plaintiffs, and those individuals' disclosure of their transgender status".

"Our military must be focused on decisive and overwhelming victory and can not be burdened with the tremendous medical costs and disruption that transgender in the military would entail". According to the lawsuit from OutServe-SLDN and Lambda Legal, a White House official told news media President Trump said his announcement "would stop the lawyers from arguing with him anymore" against reinstating a ban on transgender military service. This review process carefully considered and rejected the notion that medical costs, military readiness, or other factors presented any reason to discriminate against transgender service members, many of whom had already been serving with honor in silence for years. The armed forces were set to begin enlisting transgender people July 1, but Defense Secretary Jim Mattis delayed that move, citing a need for more study. "The most they can decide are the individual fates of now serving transgender personnel, whose presence will be inconsistent with new military policy".

Renn's lawsuit is filed in the US District Court for the Western District of Washington.
