Manhattan terrorist should get death penalty, says Trump

President Donald Trump said the Uzbek immigrant accused in the truck rampage that left eight people dead in New York City "should get death penalty".

The president lamented Tuesday morning that the judicial process of sending Sayfullo Saipov as an "enemy combatant" to the military facility in Cuba would "statistically" take longer than going through the federal system.

Trump had professed himself to be open to the idea of sending Saipov to Guantanamo in a seemingly off-the-cuff answer to questions from reporters.

Trump also said in a tweet late Wednesday that the alleged terrorist who killed eight people in NY should get the death penalty.

Mr Trump tweeted on Thursday that there is "also something appropriate" about keeping him "in the home of the terrible crime he committed".

Brought to court in a wheelchair, Saipov was held without bail on charges that could bring the death penalty. He killed 8 people, badly injured 12.

"It will endure." The phrase "it will endure" commonly refers to the Islamic State group, and Saipov had a cellphone loaded with the group's propaganda, an Federal Bureau of Investigation agent said in the criminal complaint.

"The defense is sure to raise this as unfair and raising questions about a jury being able to reach an impartial verdict", said James Acker, a professor at the School of Criminal Justice at the State University of NY in Albany who specializes in the death penalty. Saipov appeared in a NY federal courtroom on Wednesday on terrorism charges after he allegedly drove a rented pickup truck down a mile-long stretch of bike path on Tuesday in Lower Manhattan's West Side, where children and their parents were preparing to celebrate Halloween.

Senate Minority Leader Chuck Schumer, a Democrat from NY, is listed as a sponsor of the 1990 legislation that created the current visa lottery for "diversity immigrants" from countries that had historically low rates of immigration to the U.S. The legislation was signed into law by President George H.W. Bush. During the Halloween attack, he killed eight people by driving over them in a pickup truck.

Sanders said the Trump administration considers Saipov to be an "enemy combatant", but stressed that no decision had been made about how to prosecute him or where he would be detained. Authorities charged Saipov with providing support to a terrorist organization, alleging the Islamic State inspired him to carry out the attack.

The tweet could be argued as an attempt to influence a jury, but even without the intent, it still puts Trump at risk of being charged with contempt of court.

Columbia Law professor Matthew Waxman served in the Bush administration and specifically worked on Guantanamo Bay detention, and largely agreed with Vladeck that detaining Saipov would probably accomplish more harm than good.

"The folks in that unit working with the (New York Police Department) and the (Joint Terrorism Task Force) have a long and unblemished track record of successfully investigating and prosecuting domestic and global terrorists", Kim said.

It said in its weekly issue of al-Naba newspaper that "the attacker is one of the caliphate soldiers".
