Court upholds $135000 fine against Christian bakers in gay wedding cake case

An Oregon Appeals court upheld a decision ordering Aaron and Melissa Klein to pay $135K judgment for turning down making a wedding cake for a lesbian couple.

"The Kleins seek an exemption based on their honest religious opposition to same-sex marriage; but those with honest religious objections to marriage between people of different races, ethnicities, or faiths could just as readily demand the same exemption", Garrett argued.

"That is not in dispute". "And what's unfortunate here is that a family and their business has been punished because of their religious beliefs".

The decision comes weeks after the U.S. Supreme Court heard arguments in the high-profile case of a Colorado baker who refused to make a wedding cake for a same-sex couple.

BOLI ruled in July 2015 that the bakers must pay damages totaling $135,000, which led to Sweet Cakes by Melissa shutting down.

"Freedom of expression for ourselves should require freedom of expression for others", Mr. Shackelford said in a statement.

In a statement, Avakian said the Appeals Court ruling "sends a strong signal that or remains open to all". The Kleins have directed us to no evidence whatsoever that ORS 659A.403 was enacted for the objective of singling out religiously motivated action, or that BOLI has selectively targeted religion in its enforcement of the statute.

The Bowman-Cryers, meanwhile, celebrated the decision and said that in OR, businesses that are open to the public are open to all.

The court also rejected the theory (which is being pushed by some advocates in the Masterpiece case as well) that heightened scrutiny is appropriate in a Free Exercise case if other rights - like, here, Free Speech - are also implicated.

The Kleins appealed Avakian's decision, claiming that their religious beliefs do not allow them to support a same-sex wedding in any way, and that their free-speech rights would be abridged if they were compelled to apply their artistry in the service of such a wedding. "OR will not allow a "Straight Couples Only" sign to be hung in bakeries or other stores", the couple stated.

"We still get emails every once in a while out of the blue that are just saying frightful things to us", Melissa Klein told TheBlaze in a previous interview. But we feel like that is exactly what happened to us.

"I'm thankful we actually got to have our day in court", Aaron Klein said.

Aaron Klein declared that the "honest truth" is that he and his wife "just seek to serve the Lord". For us it's about following God no matter the costs.
