Gorsuch did not ask a question during an hour of arguments, while the other eight justices appeared to be equally split along ideological lines.

County Commissioner Ted Kopas said the court case was indicative of an attack on union workers in both the public and private sectors.

The court's more conservative members said that requiring workers who choose not to join public unions to pay for collective bargaining and similar activities is an affront to their right to free speech. Those union members who opt to pay only for agency shop representation, which is a small number, get a slight discount on their fees, Shaw said. "I am hopeful that after today's arguments, the United States Supreme Court will restore the rights of me and every other government employee in America".

If not for the death of Antonin Scalia two years ago after oral arguments, fees were on their way out in 2016.

Since then conservative judge Neil Gorsuch joined the supreme court. Unions strongly opposed Gorsuch's nomination by President Donald Trump.

The lead defendant, Mark Janus, is an IL child support specialist and his workplace is unionized, but Janus doesn't want to be a member of the union so he doesn't pay dues. "Whether you're the FOP, firefighters, SEIU, the laborers, we're going to recognize and respect (unions) because we're not going to turn back the labor movement". Local 1000 of the Service Employees International Union alone represents 100,000 people in this state, half of them here in Sacramento.

Janus filed his case in 2015 with free legal aid from the National Right to Work Legal Defense Foundation and the Illinois-based Liberty Justice Center. Experts say the case could strike a mortal blow to public employee unions and, by extension, Democratic Party coffers.

They agreed with a lawyer for Mark Janus, an IL state employee who objects to paying $45 a month to support his union, the American Federation of State, County and Municipal Employees.

Liberal-leaning justices, meanwhile, said ruling in favor of Mr. Janus would mean overturning a clear 1977 precedent, Abood v. Detroit Board of Education, which upheld mandatory public-sector union fees.

The fees are typically less money than the union dues but are still sometimes required of these non-member employees.

Destiny Dusosky came from St. Cloud with her mother, also an AFSCME member and her daughter, who plans to attend college next year with some financial help from the union.

Mark Janus offered the following statement: "Government workers like me should not have to bear the burden of supporting political and policy causes we disagree with in order to serve our communities and state".

IL is one of 23 states that allow unions to impose agency fees on nonmembers.

"The constitution is a contract with the American people, and that contract says I have right to freedom of speech and association, " he said.

Hundreds of union supporters including faith leaders, elected officials and immigrant rights groups attended the rally at the State Capitol.
